What is abandoned property?
Any time a tenant has vacated a rental space via by choice or eviction and leaves possessions behind it is considered abandoned property.
How do you get rid of it?
Have your legal council (eviction center, lawyer, etc.) conduct and complete the eviction process AND if necessary conduct a UCC filing search (UCC searches are usually used for commercial properties) or we can do that for you. During this process contact US at 408-497-0339 to appraise the abandoned items.
Why we suggest that?
If the landlord or property managers makes the threshold determination it could be considered with prejudice or biased and you may have legal repercussions.
Protect yourself: if the property is mishandled, and not carried out per the law, the consequences can be very costly to the landlord or managers. To protect yourself we suggest having an unbiased independent third party conduct the appraisal and if necessary, public sale of the abandoned property.
After contacting US, we will have a required inventory agreement for you to sign giving us permission to come to the site and inspect, inventory and appraise the abandoned items.
Once the appraisal is complete: We will provide you with an appraisal cover letter with our determination of threshold values.
California Civil Code Sections 1988/1993. If the property inventoried is below a threshold of 700.00 or 750.00 in value for commercial space, in most cases the property can be disposed of in any manner after proper notifications have been made.
We will provide you with our appraisal letter so you can then feel secure about meeting all the California Civil Codes required and be comfortable with any disposals.
California Civil Code Section 1988 (b) If the property is valued more than 700.00 (750.00) for commercial properties then it must be sold at a public sale with competitive bidding (An auction).
