Special Terms: Property is open to thorough public inspection. It is the Bidder’s responsibility to determine condition, age, genuineness, value, or any other determining factor. USAuctions may attempt to describe the merchandise in advertising, or on the Internet but makes no representations. In no event shall USAuctions be held responsible for having made or implied any warranty of merchantability or fitness for a particular purpose. Bidder shall be the sole judge of value. Bidders who bid from off site and are not present at the preview understand and acknowledge that they may not be able to inspect an item as well as if they examined it in person. USAuctions will attempt to indicate all discrepancies noted to assist you in your decision making.
Charge Backs: You are also agreeing on a no charge back policy. The bidder agrees that everything is sold as is where is and that they may not return any item they purchase. USAuctions is providing Internet bidding as a service. Bidder acknowledges and understands that this service may or may not function correctly the day of the auction and USAuctions reserves the right to withdraw or re-catalog items in this auction.
Postponement and Cancellation: USAuctions reserves the right to postpone or cancel any Auction, or any sale resulting therefrom, at its own discretion, without notice. USAuctions will have no liability to prospective bidders or Sellers as a result of any withdrawal, cancellation or postponement of Auctions or sales.
Refunds and Cancellation of Bids:
Shipping Services: They buyer is responsible for all packing and shipping arrangements. USAuctions will assist in boxing up non-breakable items and a box size not more than 20x20x20 with weight not reaching more than 30 lbs. All boxes must go out fully insured and “The Buyer” will be required to file for all claims. Shipping is case by case and requires an a approval agreement prior to shipping.
Freight and Transportation: The Buyer is responsible for all freight, shipping and other costs related to transporting Auction Items from the posted Auction location, including but not limited to any costs associated with certificates and/or permits required to move Auction Items within or across state, province and/or country borders. Buyers are advised to have all such certificates and permits issued and completed prior to transporting the equipment; otherwise, Buyer may be subject to cleaning, permit, and/or other fees if the Items are stopped and held at a Port of Entry to a state, province, or country. Buyers may arrange transportation of Auction Items on the Website through a third party, but USAuctions will not be liable for any acts or omissions arising from such third-party transportation and claims no responsibility for the actions of any transportation provider. If the person picking up and removing Items from an auction location will be someone other than the registered Buyer, the registered Buyer must establish that person or company as an “Authorized Agent” by completing an “Agent Release Authorization” form. Buyers may not transport Auction Items until full payment (including any applicable sales tax and Buyer’s Premium) has been received posted to a secure payment account designated by USAuctions. All BOL will be required with a licensed signature.
Standard Return Policies: All items are sold in “as is” condition. All hand signatures, stones and metals should be considered cosmetic unless we describe and confirm the authenticity of the item. Many goods are found in the home or unit, and we cannot authenticate them. We do our best to gather the history, look for documentation, and present it to you so you may make your final purchase decisions. Weight, size, estimated value, origin, grade, quality, age, condition, rarity, and importance, are not guaranteed for any item. With regards to coins, some coins may come in slabs by third party graders. We are not coin graders and cannot guarantee grade of any coin. If there are any discrepancies, please contact the lead auctioneer and between you and she any return decisions can be decided upon.
Guns and AMMO: All gun Auctions are considered a provisional sale. Any guns coming in from an estate will be turned over to our FFL. The auction will be conducted provisionally meaning once the auction is over, the buyer and FFL will get together to complete all the necessary paperwork required to make a legal transfer. If the new buyer bids/wins and does not clear through the FFL then he will lose his money and the sale will be forfeited. DO NOT BID unless you are compliant and legal to own a gun for any state that you may want to purchase a gun. If the gun does not clear, then a FULL refund will be given to the buyer. Once the paperwork is complete, the FFL will either release or ship the gun to your provided and approved FFL to complete a transfer. All online AMMO will be handled in the same manner. Shipping fees and transfer fees will be the responsibility of the new buyer.
